Abstract
This paper explores the factors affecting Pardanashin women and the legal protections available to them. It examines the historical context, the factors influencing their ability to enter into contracts, and the level of protection provided. The paper evaluates Section 16 of the Indian Contract Act, 1872, and discusses the need to bridge the gap between women and men. Pardanashin women are those who are completely secluded from the world. They are not considered Pardanashin if they go to court, settle rent, collect rent, give evidence, or interact for business. Various factors influence them, including psychological impacts, political and economic factors, globalization, health, and social relations. The Indian Contract Act, 1872 provides special protection to ensure they are not disadvantaged. This paper also discusses landmark judgments that have shaped the law for Pardanashin women. It concludes with suggestions for improving their situation through independence, modernity, education, awareness, and compulsory voting.
